This policy explains how Fresh Mart Group (RC1693468) (“Fresh Mart”, “we”, “us”) collects and uses personal information when you shop on freshmart.com.ng, use the Fresh Mart Shopping app on iPhone or Android, pay for an order, or contact us. Fresh Mart is a supermarket chain in Delta State, Nigeria, and is the data controller for the information described here.
1. Information we collect
Information you give us
- Account details: your email address or phone number (used to sign in with a one-time code) and, if you add it, your name.
- Delivery details: saved delivery addresses, including a label (for example “Home”), recipient name, phone number, city, street address and any delivery notes.
- Order information: the products, quantities and prices in your cart and orders, the order reference, delivery fee, payment status, delivery status and messages about the order.
- Support messages: what you send us when you ask for help or make a privacy request.
Information collected automatically
- Push notification token: if you allow notifications in the app, we store your device’s push notification token, the platform (iOS or Android) and the device model so we can send order updates. You can turn notifications off at any time in your phone’s settings.
- Sign-in session: after you sign in, a session token is kept in your phone’s secure storage so you stay signed in. Signing out removes it.
- Technical and security logs: our servers record basic request information such as IP address, browser or app type, timestamps and error logs to keep the service working and secure. The website also uses cookies and local storage to keep your cart and session working.
The Fresh Mart Shopping app does not contain advertising, analytics or crash-reporting software, does not track you across other apps or websites, and does not access your camera, photos, microphone, contacts or location.
2. How we use information
- To create your account and sign you in with a one-time code.
- To price, create, confirm, prepare, deliver and track your orders.
- To confirm payment status and reconcile transactions.
- To contact you about your order, substitutions, delivery, refunds or support, and to send order-update notifications.
- To prevent fraud, abuse and unauthorised access.
- To keep business, accounting and legal records.
- To fix problems and improve the reliability of our services.
- With your consent only, to send marketing messages. You can withdraw consent or unsubscribe at any time.
3. Payments
Online payments are processed by Paystack. Your card number, card security code and bank login details are entered on Paystack’s secure payment page and are not stored by Fresh Mart. We receive only the transaction reference, amount and payment status so we can confirm and fulfil your order. Paystack handles payment information under its own privacy policy.
4. Sign-in codes
We sign you in with a one-time code instead of a password. Codes sent by SMS are delivered through our SMS provider, BulkSMSNigeria, which receives your phone number and the code. Codes and order emails sent by email are delivered through our email provider, Zoho Mail, which receives your email address and the message.
5. Who we share information with
We share personal information only as needed for the purposes above:
- Fresh Mart branch staff and delivery personnel who prepare and deliver your order (they receive your name, phone number, delivery address and order details).
- Service providers acting for us: Paystack (payments), BulkSMSNigeria (SMS codes), Zoho (email), DigitalOcean (servers and database hosting), Cloudflare (website security and delivery network), and Apple and Google (delivering push notifications to your device).
- Professional advisers and public authorities when required by law.
We do not sell your personal information.
6. Where your information is stored
Our servers and database are hosted by DigitalOcean and our website traffic passes through Cloudflare. These providers may process data outside Nigeria. Where that happens we rely on their contractual and security commitments to protect it, as permitted by the Nigeria Data Protection Act 2023.
7. How long we keep information
- Account and saved addresses: while your account is active, and deleted when you ask us to delete your account.
- Orders and payment records: for as long as needed to fulfil orders, handle refunds and disputes, and meet accounting, tax and legal record-keeping duties.
- Push notification tokens: until you turn off notifications, sign out, delete your account, or the token stops working.
- Technical logs: for a limited period needed for security and troubleshooting.
When information is no longer needed we delete or anonymise it.
8. Security
We use HTTPS encryption for all connections, keep sign-in sessions in your phone’s secure storage, restrict access to administrative systems, and follow operational safeguards. No online service can guarantee absolute security. If you think your account or an order has been accessed without your permission, contact us straight away.
9. Your rights
Under the Nigeria Data Protection Act 2023 you have the right to:
- access the personal information we hold about you;
- correct information that is wrong or incomplete;
- delete your information, subject to records we must keep by law;
- object to or restrict certain uses, including direct marketing;
- withdraw consent where we rely on it;
- receive your data in a portable format where applicable; and
- complain to the Nigeria Data Protection Commission (NDPC) at ndpc.gov.ng.
To use any of these rights, email [email protected]. We may ask you to confirm your identity before acting on a request, and we will reply within the time the law allows.
10. Deleting your account and data
The app does not yet have an in-app delete button. To delete your account and personal data, email [email protected] from the email address on your account, or include the phone number you sign in with, and write “Delete my account” in the subject. We will confirm your identity, delete your account, saved addresses and push tokens, and confirm when it is done. We will keep only the order and payment records we are legally required to retain.
You can update your name and saved addresses in the app at any time.
11. Children
Our services are not directed at anyone under 18, and we do not knowingly collect personal information from children. Alcoholic drinks are sold only to customers aged 18 or over. If you believe a child has given us personal information, contact us and we will delete it.
12. Changes to this policy
We may update this policy when our services, providers or legal duties change. We will publish the new version on this page and change the effective date at the top.
